Access to the website is free of charge, except for the cost of the connection via the telecommunications network provided by the internet service provider contracted by the users.

They appear on the Grupo Casanis website solely for promotional purposes and to gather information. These owners may request that the information pertaining to them be modified or removed.

3. Condiciones de uso del portal

3.1 General

The User agrees to use the Portal properly in accordance with the law and this Legal Notice. The User shall be liable to Grupo Casanis or to third parties for any damages that may result from a breach of this obligation.

It is expressly prohibited to use the Portal for purposes that harm the property or interests of Grupo Casanis or third parties, or that in any other way overload, damage, or render inoperable the networks, servers, and other computer equipment (hardware) or computer products and applications (software) of Grupo Casanis or third parties.

3.2 Contents

The User agrees to use the Content in accordance with the law and this Legal Notice, as well as with any other terms, regulations, and instructions that may apply in accordance with the provisions of Clause 1.
By way of example only, the User, in accordance with applicable law, must refrain from:

  • Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Content, except in cases authorized by law or expressly consented to by Grupo Casanis or by the holder of the exploitation rights, as applicable.
  • Reproducing or copying, for private use, Content that may be considered Software or a Database in accordance with current intellectual property laws, as well as publicly communicating or making such Content available to third parties when these acts necessarily involve reproduction by the User or a third party.

3.3 Adding Links to the Portal

Any Internet user who wishes to include links from their own websites to the Portal must comply with the conditions detailed below; ignorance of these conditions does not exempt the user from the liabilities established by law:

4. Disclaimer

4.1 Information

Grupo Casanis assumes no liability for decisions made based on the information provided on the Website, nor for any damages incurred by the User or third parties as a result of actions taken solely on the basis of information obtained from the Website.

4.2 Service Quality

Access to the Portal does not imply any obligation on the part of Grupo Casanis to ensure the absence of viruses, worms, or any other harmful computer programs.

In any case, it is the User’s responsibility to have the appropriate tools available for detecting and removing harmful computer programs.

Grupo Casanis is not liable for any damage caused to Users’ or third parties’ computer equipment during the provision of the Portal’s services.

4.3 Availability of the Service

Access to the Portal requires third-party services and supplies, including transmission via telecommunications networks whose reliability, quality, continuity, and operation are beyond the control of Grupo Casanis. Consequently, the services provided through the Portal may be suspended, canceled, or rendered inaccessible, either prior to or concurrently with the provision of the Portal’s service.

Grupo Casanis is not liable for any damages or losses of any kind incurred by the User resulting from failures or disconnections in telecommunications networks that cause the suspension, cancellation, or interruption of the Portal’s service during or prior to its provision.

4.4 Content and Services Linked Through the Portal

The Portal’s access service includes technical linking mechanisms, directories, and even search tools that allow the User to access other Internet pages and portals (hereinafter, “Linked Sites”). In these cases, Grupo Casanis acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of July 12, on Information Society Services and Electronic Commerce (LSSI) and shall only be liable for the content and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not deactivated the link with due diligence. In the event that the User believes that a Linked Site contains unlawful or inappropriate content, the User may notify Grupo Casanis in accordance with the procedure and consequences set forth in clause 6; however, under no circumstances shall such notification entail an obligation to remove the corresponding link.

Under no circumstances shall the existence of Linked Sites imply the existence of agreements with the parties responsible for or owners of such sites, nor shall it imply that Grupo Casanis endorses, promotes, or identifies with the statements, content, or services provided.
Grupo Casanis is not familiar with the content and services of the Linked Sites and therefore assumes no liability for damages resulting from the illegality, quality, outdated nature, unavailability, errors, or uselessness of the content and/or services of the Linked Sites, nor for any other damages not directly attributable to Grupo Casanis.

6. Reporting of Illegal and Inappropriate Activities

In the event that the User or any other Internet user becomes aware that the Linked Sites lead to pages whose content or services are unlawful, harmful, defamatory, violent, or contrary to public morals, they may contact Grupo Casanis, providing the following information:

  1. Personal information of the reporting party: name, address, phone number, and email address;
  2. Description of the facts revealing the unlawful or inappropriate nature of the Linked Site;
  3. In the event of a violation of rights, such as intellectual and industrial property rights, the personal information of the holder of the infringed right, if different from the person making the report.
  4. You must also provide documentation proving the rights holder’s standing and, if applicable, proof of authority to act on behalf of the rights holder when the rights holder is a person other than the person making the report;
  5. An express statement that the information contained in the complaint is accurate.

Receipt by Grupo Casanis of the notification provided for in this clause shall not imply, in accordance with the provisions of the LSSI, actual knowledge of the activities and/or content indicated by the notifying party.

Likewise, the complainant must provide documentation proving the rights holder’s standing and, where applicable, the authority to act on behalf of the rights holder when such person is different from the complainant.

7. Notifications

All notices and communications issued by the parties shall be valid in accordance with the means permitted by law. Those relating to this Portal shall be considered effective for all purposes if they are made through the Portal itself.

8. Amendments

Grupo Casanis reserves the right to make any changes it deems appropriate to its website without prior notice, and may change, remove, or add both the content and services provided through the website and the way in which they are presented.

10. Legislation

This Legal Notice is governed in its entirety by Spanish law. Provided that the applicable law permits the waiver of the established jurisdiction, the courts of Málaga are designated as the venue for resolving any disputes, and the user expressly waives any other jurisdiction that might apply.
